Terms of Service

By accessing or using ModomoPay, you confirm that you are at least 18 years of age and legally able to enter into a binding contract on behalf of yourself or your business.

ModomoPay provides software that lets merchants create invoices, payment links, subscriptions, and point-of-sale charges. The service does not custody funds, provide banking services, or act as a money transmitter. Blockchain payments settle directly to the merchant wallet; card payments are processed by third-party providers.

Accounts are invite-only. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree not to use the service to:

• Process payments for illegal goods, services, or activities.
• Evade sanctions, money laundering laws, or other legal obligations.
• Impersonate another person or misrepresent your business.
• Interfere with the security or availability of the service.

Network fees for blockchain payments are paid by the payer or merchant depending on settings. Card processing fees are set by the third-party provider. ModomoPay does not hold merchant funds.

We may suspend or terminate access to the service for violations of these terms or for any other reason at our discretion.

The service is provided "as is" without any warranty, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, ModomoPay shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or in connection with your use of the service. Our aggregate liability for any claim shall not exceed the amount paid by you to us in the twelve months preceding the claim.

You agree to indemnify and hold harmless ModomoPay, its owners, employees, and affiliates from any claim, damage, or expense arising from your use of the service or your violation of these terms.

These Terms are governed by the laws of the United States and the state in which ModomoPay is registered, without regard to conflict-of-laws provisions.

We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the revised Terms.
