Software Disclaimer & Non-Custodial Notice

ModomoPay is a non-custodial, self-hosted software interface operated by ModomoPay LLC, Pennsylvania, USA. It lets any user — an individual, a group, or a business — create invoices, payment links, and in-person keypad charges that another person can settle using supported digital assets or card on-ramps.

ModomoPay is a technology provider. It is not a bank, financial institution, money services business, money transmitter, custodian, broker, escrow agent, or payment processor. We do not receive, hold, or transfer funds on behalf of any user.

ModomoPay is a neutral, open-access software utility designed for direct peer-to-peer transfers. Whether someone is collecting $5 for cookies, splitting a dinner tab, selling an item locally, or invoicing for freelance work, the software is blind to the reason.

• No purpose knowledge or verification. ModomoPay has no visibility into, control over, or involvement in the underlying reason for any transaction, and does not monitor, evaluate, underwrite, or approve transactions.
• Peer responsibility. Users retain sole responsibility for ensuring that their transactions comply with all applicable local, state, federal, and international laws, including tax reporting, licensing, sales tax, and consumer-protection regulations.
• No tax reporting. ModomoPay does not provide tax reporting (such as Form 1099-K generation) and does not act as a tax withholding agent.

ModomoPay never takes possession, custody, or control of user funds, cryptographic tokens, fiat currency, or private keys at any point during a transaction.

• Wallet creation, key generation, and transaction signing happen on the user's own client-side device through embedded, non-custodial wallet infrastructure.
• ModomoPay does not store, back up, or have access to private keys, recovery phrases, or wallet credentials.
• Users retain sole ownership, responsibility, and operational control over the wallets they connect or generate and the assets held at those wallet addresses.

Blockchain payments are executed directly on-chain between the sender's wallet and the recipient's wallet. ModomoPay provides the interface that generates invoices, links, and QR codes, but it does not sit in the flow of funds.

Once a sender confirms an on-chain transaction, settlement is final and irreversible by ModomoPay. Network confirmations and finality are governed by the underlying blockchain protocol, not by ModomoPay.

Recipients may optionally show their own handles for external payment apps — Zelle, Venmo, Cash App, or PayPal — so a sender can pay in an app they already use instead of on-chain. ModomoPay is not affiliated with, endorsed by, or sponsored by Zelle, Early Warning Services, LLC, Venmo, Cash App, Block, Inc., PayPal, or their operators, and does not process, route, settle, hold, verify, or guarantee those payments — they move directly between the two people inside those apps.

ModomoPay cannot verify payments made in external apps. The software only displays the handle to send to. Marking such a payment as received is a manual action taken by the recipient, not verification by ModomoPay, and we cannot reverse or recover it.

ModomoPay may integrate with third-party services to improve the payment experience, such as card on-ramp providers (for example, MoonPay) and blockchain network infrastructure. These third parties operate under their own terms and policies, and they may perform their own compliance, KYC, or risk reviews where required by law.

ModomoPay is not responsible for the availability, performance, policies, or compliance practices of any third-party service, network, or blockchain protocol.

Because payments settle directly on-chain to user-controlled wallets, ModomoPay cannot reverse transactions, process refunds, initiate chargebacks, or mediate payment disputes between senders and recipients.

Any refund, return, or dispute must be resolved directly between the sender and the recipient. Recipients are solely responsible for their own refund, cancellation, and support policies.

By using ModomoPay, senders and recipients agree that they are responsible for:

• Safeguarding their own wallet credentials, keys, and recovery phrases.
• Verifying wallet addresses and payment amounts before confirming any transaction.
• Complying with all applicable laws, tax obligations, and sanctions requirements in their jurisdiction.
• Setting clear refund and cancellation policies for the people who pay them.

The ModomoPay software is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Blockchain networks, wallets, and third-party on-ramps may experience delays, downtime, or errors outside of our control.

We may update this notice from time to time. Changes take effect when posted on this page. Continued use of the service after changes constitutes acceptance of the revised notice.
